Welcome to Community. These Terms of Service (“Terms”) govern your access to and use of Community, a local marketplace owned and operated by Enrollsy, Inc. (“Enrollsy,” “we,” “us,” or “our”). By using Community, you agree to these Terms.
If you don’t agree, please don’t use Community. We’ve tried to keep this readable — if something doesn’t make sense, email us at support@enrollsy.com.
1. Who These Terms Apply To
Community has two main types of users:
- Consumers: Anyone who browses Community to find classes, programs, camps, workshops, activities, or other enrollment opportunities, or who submits an inquiry or lead through a listing. Consumers don’t need to create an account.
- Subscribers: Businesses, schools, instructors, and program operators who claim or create a listing on Community, with or without a paid subscription.
These Terms apply to both. Some sections apply only to Subscribers — those are clearly marked.
By using Community, you confirm that you are at least 18 years old, or that you are using Community with the involvement and consent of a parent or legal guardian.
2. About Community and Enrollsy
Community is a marketplace that connects local Consumers with Subscribers offering classes, programs, camps, workshops, and activities. Community is owned and operated by Enrollsy, Inc.
Community is a separate product from Enrollsy’s enrollment management software. Subscribing to Community does not require an Enrollsy software subscription, and vice versa.
Enrollsy is a Delaware corporation headquartered in Utah. You can reach us at:
Enrollsy, Inc.
Email: support@enrollsy.com
3. Your Account (Subscribers Only)
To claim a listing or subscribe to a paid plan, you’ll need to create a Subscriber account. You agree to:
- Provide accurate, current, and complete information
- Keep your account credentials secure and not share them
- Notify us immediately at support@enrollsy.com if you suspect unauthorized access
- Be responsible for all activity that occurs under your account
We may suspend or terminate accounts that we reasonably believe are inaccurate, fraudulent, abusive, or in violation of these Terms.
4. Listings and Content (Subscribers)
4.1 What You Can Post
As a Subscriber, you can create or claim a listing that includes information about your business, programs, hours, location, photos, and similar details. You’re responsible for the accuracy and legality of everything you post.
4.2 What You Can’t Post
You agree not to post content that:
- Is false, misleading, or fraudulent
- Infringes anyone else’s intellectual property rights
- Is defamatory, harassing, threatening, or hateful
- Promotes illegal activity
- Contains malware, spam, or links to malicious sites
- Misrepresents your relationship to the business being listed
- Targets, sexualizes, or otherwise endangers minors
- Discriminates on the basis of race, religion, gender, sexual orientation, disability, or any other protected category in violation of applicable law
4.3 Ownership of Your Content
You keep ownership of the content you post (your business name, descriptions, photos, etc.). By posting it on Community, you grant Enrollsy a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as needed to operate, promote, and market Community. This license ends when you remove the content, except that we may retain backup copies and aggregated/anonymized data.
4.4 Listing Verification
For listings to be activated, we may ask you to verify that you’re authorized to represent the business — through email at the business domain, SMS verification at the business phone number, or manual review. We reserve the right to remove listings that we reasonably believe are unauthorized.
4.5 Our Right to Moderate
We may, at our sole discretion, edit, reject, suspend, or remove any listing or content that we believe violates these Terms or harms the integrity of the marketplace. We’ll usually give notice and a chance to fix the issue, but we don’t have to.
5. Subscriptions, Pricing, and Payments (Subscribers)
5.1 Tiers and Flat-Rate Pricing
Community offers a free tier and several paid subscription tiers. Each paid tier has a flat monthly rate, billed in advance. Current pricing is shown on our Pricing page and may change with notice.
We do not take a percentage of your revenue. What your Consumers pay you stays with you — we are not a payment processor for end-customer transactions, and we do not deduct fees from your earnings.
5.2 Billing
Paid subscriptions are billed monthly by Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method on the same day each month until you cancel.
You agree to keep your payment information accurate and up to date. If a payment fails, we may downgrade your listing to free-tier features and notify you to update your payment method. If the issue isn’t resolved within a reasonable time, we may suspend or cancel your subscription.
5.3 Taxes
You are responsible for any applicable taxes related to your subscription. Where required by law, applicable taxes will be added to your invoice.
5.4 Cancellation
You can cancel your paid subscription anytime from your dashboard. Cancellation takes effect at the end of the current billing period — you keep your tier features until then. We do not offer refunds for partial billing periods, except where required by law.
5.5 Price Changes
We may change subscription prices with at least 30 days’ written notice (sent to the email address on your account). Price changes apply at your next renewal. If you don’t agree to the new price, you can cancel before the change takes effect.
5.6 Free Tier
The free tier is offered as-is and may be modified or discontinued at any time. Free-tier listings have limited features as described on the Pricing page.
6. Lead Submissions (Consumers)
When you submit an inquiry through a Community listing — whether it’s a request for information, an enrollment, an application, or a tour — you understand that:
- Your information (name, email, phone if provided, message, and other fields you fill in) is sent to the Subscriber whose listing you contacted
- The Subscriber will contact you directly using the information you provide
- Community is not a party to any agreement, transaction, or relationship that develops between you and the Subscriber after that point
- You are responsible for evaluating the Subscriber and their offerings before enrolling, paying, or otherwise engaging with them
Don’t submit anyone else’s personal information without permission. Don’t submit false information. Don’t use Community to harass, scam, or solicit Subscribers.
7. The Relationship Between Consumers and Subscribers
Community is a marketplace, not a party to the relationship between Consumers and Subscribers.
We don’t control, endorse, or guarantee:
- The accuracy of any listing
- The quality, safety, or legality of any class, program, camp, workshop, activity, or other offering
- The qualifications, certifications, or background of any Subscriber
- Whether any enrollment, application, or transaction will be honored
We encourage Consumers to do their own research — verify credentials, ask questions, read independent reviews, and trust your judgment. We encourage Subscribers to respond to leads professionally, accurately, and promptly, and to comply with all applicable laws (including background checks, licensing, and child safety requirements where relevant).
8. Acceptable Use
You agree not to:
- Use Community in any way that violates applicable law
- Scrape, crawl, harvest, or otherwise extract data from Community in bulk without our written permission
- Use bots, automated tools, or fake accounts to submit leads, claim listings, manipulate search results, or otherwise interfere with the marketplace
- Reverse-engineer, decompile, or otherwise attempt to extract Community’s source code
- Resell, sublicense, or otherwise commercialize Community itself (as opposed to the listings you’re authorized to operate)
- Upload viruses, malware, or any code intended to harm or disrupt Community
- Impersonate any person or business
- Circumvent rate limits, spam filters, or other security measures
Violation of this section may result in immediate account termination and, where appropriate, legal action.
9. Intellectual Property
Community, the Community brand, the Community logo, and all related software, design, text, graphics, and content created by Enrollsy are owned by Enrollsy, Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or use them without our written permission, except for fair-use display of listings as users of the marketplace.
If you believe content on Community infringes your copyright, please send a takedown notice to support@enrollsy.com with the information required under the Digital Millennium Copyright Act (DMCA).
10. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Please read it.
11. Disclaimers
Community is provided “as is” and “as available,” without warranties of any kind, express or implied.
To the maximum extent allowed by law, Enrollsy disclaims all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, completeness, or reliability of any listing, content, or information
We don’t guarantee that Community will be uninterrupted, error-free, secure, or that defects will be corrected. We don’t guarantee specific results from using Community — including the number of leads, conversions, or revenue you’ll generate as a Subscriber.
Some jurisdictions don’t allow these disclaimers — in that case, they apply to the maximum extent permitted by law.
12. Limitation of Liability
To the maximum extent allowed by law, Enrollsy will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of Community — including lost profits, lost data, lost goodwill, business interruption, or substitute services — even if we’ve been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to these Terms or Community is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD.
Some jurisdictions don’t allow these limitations — in that case, they apply to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Enrollsy, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of Community
- Your content (including listings, photos, descriptions, and lead submissions)
- Your violation of these Terms
- Your violation of any law or third-party right
This obligation survives termination of your account and these Terms.
14. Termination
You can stop using Community anytime. Subscribers can cancel paid subscriptions from their dashboard.
We can suspend or terminate your access to Community — with or without notice — if we reasonably believe you’ve violated these Terms, if we’re required to by law, or if continuing to provide service would create undue risk for us or our users.
On termination:
- Your right to use Community ends immediately
- Sections that by their nature should survive (Sections 4.3, 8, 9, 11, 12, 13, 15, 16, and any payment obligations) will survive
- We may retain certain information as described in our Privacy Policy
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules.
15.1 Informal Resolution First
Before filing any formal claim, you agree to first contact us at support@enrollsy.com and try to resolve the issue informally. We’ll do the same. Most disputes can be resolved with a quick email exchange.
15.2 Binding Arbitration
If we can’t resolve a dispute informally within 60 days, any dispute arising out of or relating to these Terms or Community will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Salt Lake County, Utah, or remotely if both parties agree. The arbitrator’s decision will be final and binding.
15.3 Class Action Waiver
You and Enrollsy each agree that disputes will be resolved on an individual basis, not as part of a class, collective, or representative action. The arbitrator may not consolidate claims or preside over a class arbitration.
15.4 Exception for Small Claims and Injunctive Relief
Either party may bring an individual claim in small-claims court if eligible, or seek injunctive relief in court for intellectual property infringement or breach of confidentiality.
15.5 Opt-Out
You may opt out of the arbitration agreement in Section 15.2 and the class action waiver in Section 15.3 by sending written notice to support@enrollsy.com within 30 days of first agreeing to these Terms. Your notice must include your full name, address, and a clear statement that you wish to opt out.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page and, for material changes, notify Subscribers by email at least 30 days before the change takes effect. Your continued use of Community after the change means you accept the updated Terms. If you don’t agree, stop using Community.
17. Miscellaneous
Entire agreement. These Terms (together with the Privacy Policy and any other policies referenced) are the complete agreement between you and Enrollsy regarding Community.
Severability. If any part of these Terms is held to be unenforceable, the rest remains in effect.
No waiver. Our failure to enforce any part of these Terms doesn’t waive our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
Notices. We’ll send notices to the email address on your account. You can send notices to us at support@enrollsy.com.
Contact. Questions? Email support@enrollsy.com. We’re real people and we read every email.
